RENTAL AGREEMENT

This Rental Agreement (“Agreement”) is entered into on this 21st day of January 2025 by and between:

1. Rental Property

The Landlord agrees to rent to the Tenant the following property:

Description: 1-bedroom apartment, 48 sq.m., located on the 6th floor of the Siam Oriental Twins condominium.

Address: 267 Moo 12 Nongprue, Banglamung, Chonburi, Thailand 20150.

2. Term of Lease

The lease term shall begin on 21 January 2025 and end on 21 February 2025.

3. Rent and Security Deposit

Monthly Rent: The total rent for the lease term is 25,000 THB, payable in full either together with the security deposit or upon check-in.

Security Deposit: A refundable security deposit of 15,000 THB is required. The deposit must be transferred to the Landlord’s bank account no later than the due date specified in the issued invoice. Proof of payment must be provided by the Tenant. The deposit is refundable upon completion of the lease, provided there are no outstanding charges, damages, or violations of this Agreement.

4. Payment Terms

All payments shall be made via bank transfer to the account specified by the Landlord or by another mutually agreed payment method.

5. Rules and Regulations

The Tenant confirms that they have reviewed, understood, and agreed to comply with the Rules and Regulations for Services published at https://thaiproperty.space/terms/.

The Tenant confirms that they are thoroughly familiar with the rented property, its layout, furnishings, and current condition, as presented in the 3D model of the apartment available at https://thaiproperty.space/3dtwin_en/.

6. Utilities and Additional Fees

Utilities such as water, electricity, and sewage are not included in the rent and shall be charged according to actual usage based on the condominium’s rates. Final cleaning upon check-out is subject to an additional fee as specified by the management company.

7. Check-In and Check-Out

Check-In: 21 January 2025, after 2:00 PM.

Check-Out: 21 February 2025, before 12:00 PM. Early check-in or late check-out is subject to prior approval and may incur additional charges.

8. Special Conditions Regarding Sale of the Property

  • The Tenant acknowledges that the rented property is currently listed for sale.
  • If a buyer is found during the rental period, the Landlord reserves the right to terminate the Agreement early.
  • In such a case, the Landlord will provide the Tenant with at least 10 calendar days' written notice to vacate the apartment.
  • The Tenant agrees to vacate the property within the specified timeframe.
  • The Landlord shall refund the Tenant for any unused rental days remaining after the property is vacated, based on a prorated calculation of the monthly rent.

9. Tenant Obligations

  • Maintain the apartment in a clean and undamaged condition.
  • Promptly report any damages or maintenance issues to the Landlord.
  • Abide by all condominium rules and regulations.
  • Use the apartment exclusively for residential purposes.

10. Prohibitions

  • The Tenant shall not sublet or assign the property to any third party without the Landlord’s prior written consent.
  • Smoke or allow pets within the apartment.
  • Use the property for illegal activities or purposes not authorized by this Agreement.

11. Termination

Early termination by the Tenant is subject to forfeiture of the security deposit unless otherwise agreed in writing with the Landlord. The Landlord may terminate this Agreement and retain the deposit in cases of significant breach of rules or non-payment.

12. Liability

The Landlord is not responsible for the loss or damage of the Tenant’s personal belongings.

13. Governing Law

This Agreement shall be governed by the laws of the Kingdom of Thailand.

14. Entire Agreement

This Agreement, along with the Rules and Regulations, constitutes the entire agreement between the parties. Any modifications must be in writing and signed by both parties.
